IVA and a seperate account
I took an IVA in November 2008. Included in it was a current account with Barclays which was approx £300 overdrawn. Two months before this in September 2008, my new partner put my name on her Barclays account.
Since my IVA was approved, Barclays Collection Dept. also known as Consumer Finance, have pestered me constantly about the current account. I told them it was covered under the IVA, but they kept saying they hadn't received any info. My DMC eventually contacted them, and the calls and letters stopped.
However, in May 2009, Barclays cancelled our debit card, and all the direct debits from our joint, completely seperate, account. We contacted our branch, and they apologised and re-activated it and promised to investigate how it happened.Surprise, Consumer Finance had associated my name and stopped what was really my partners account. By then, direct debits had failed and we had to request mandates to set up new DDs. We have been promised a full refund of any charges we may get.
Are the actions Consumer Finance taken legal and can I take this further?

Ive just spoken with the Bank and they say it was just a dreadful mistake by Consumer Finance, and my custom is very important to them blah blah. They dont wanna throw money at the problem "but what would it take in the way of compensation" for me to trust them in future.I've asked them to investigate further as to who did it and why it happened, then we can negotiate. What do you all think is sufficient?0

I believe that as your name was on your partners account the bank is entitiled to seize funds from that account in order to satisfy the debt you owe on your own account. So it sounds like you're lucky the bank didnt take up this option. It's never a good idea to hold or enter into a joint account when in an IVA as you will be a huge drag on your partners credit rating.Debt as at 12th July 2006 - £61,345 :eek: :eek: :eek:
