Moving partway through rental period

I am in a periodic tenancy, paying rent monthly on the 31st.
I recently sent notice to the LA on 28th May notifying them that I would like to leave on the 5th of July. They have arranged viewings of my flat but I have heard nothing about moving out.
If the LA does not raise the issue of moving out dates is that tacit acceptance of a pro rata agreement for 1 week? Should I ask them to put this in writing? If I do not get it in writing is there a chance 1 months rent will be subtracted from the deposit?
If the do plan on charging 1 months rent for 5 days of occupation can I now tell them I will move on the 31st of May instead? Thereby moving at the end of a rental period?
My new place may be ready on the 29th of June but I cannot take any time off during the week to move my furniture etc, plus I am only moving somewhere else temporarily for 3 months so if I push it back a month to 31st July the move becomes somewhat pointless. In that case can I withdraw notice at no cost?
It does seem unfair that you can only move out at the end of a rental period even if you give more than 1 months notice! How can you avoid paying for two properties at once!

So you know that they have received your notice....They have arranged viewings of my flat but I have heard nothing about moving out.
No, yes and yes..If the LA does not raise the issue of moving out dates is that tacit acceptance of a pro rata agreement for 1 week? Should I ask them to put this in writing? If I do not get it in writing is there a chance 1 months rent will be subtracted from the deposit?
What you should have done was give the proper notice to end properly at the end of the rent period and *asked* whether they would agree to you staying on for the extra time and you paying pro-rata. Just send a follow up letter, referring to original notice letter, asking them if they will agree to the pro rata payment & if so, would they confirm in writing. Most LAs/LLs don't have a problem with this so long as they know *before* they line up the new T. They couldn't ask you to pay the full rent *if* they got a new T to move in on the 6th, but obviously you have no guarantee that they will have someone in place to tie in with that date.If the do plan on charging 1 months rent for 5 days of occupation can I now tell them I will move on the 31st of May instead? Depends on the LA/LL and how far they have got with finding the new Ts.My new place may be ready on the 29th of June but I cannot take any time off during the week to move my furniture etc, plus I am only moving somewhere else temporarily for 3 months so if I push it back a month to 31st July the move becomes somewhat pointless. In that case can I withdraw notice at no cost?
Negotiate, negotiate at both ends - the current place and the new place. You have to look at it both ways though, you have a tenancy agreement which gives both parties rights and obligations, and if you have committed yourself to a contract ( with a follow on stat periodic) then you have to abide with its notice requirements unless the other side agrees otherwise. It does seem unfair that you can only move out at the end of a rental period even if you give more than 1 months notice! How can you avoid paying for two properties at once!
Most LLs *will* try to work with you in this sort of scenario but only if discussed well in advance, and if they are not going to lose out financially. Good luck

OK I see what you are saying.
On the notice period though if the notice was received on the 29th of May (and I have proof) am I entitled to move out on the 30th June and pay no more rent?0 -

No, notice can only end at the end of a rent period.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Yes but the rental period in question is 31st May -> 30th June and notice was received (with an incorrect date) on 29th May ie before one full rental period.0

You have given notice to leave in the middle of a rental period. You can do this but you are liable for the rent until the end of the rental period ie til end July.I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
