No i dont mind atall terry, im in the swanny without a certain paddle now, and yes hethmar, i wont give this up either, i see it as my rightful inheritance, and i believe they have lied as its only 10 years posession they have had, and its 12 years they need for unregistered adverse posession. so maybe thats in my favour.
Thanks also pee, a stat dec from tenant is also some ammunition i guesss, good thinking.

cant believe LR gave this possesory title to him without knowing he was there for full 12 years, yes 10 years, but hes lied about 12 years, and must have some official signatory behind his stat dec too. They will be sorry for their decietful intentions.;)0 -

Spoke to land registry who say that the law is on the squatters side of non registered land, in their view he is the recognised and registered owner, as his statutory declaration, signed by solicitor is legally binding.
As part of the registration process for this adverse posession, the land registry solicitors served notice to all parties (neighbours in surrounding houses) including my parents for any objection. They had no objections sent back to them. !
They said that i can pursue a legal case against this, but i have to pick up the charges even if the land is given back to me. apparently i have to give an amazingly convincing answer supported by evidence of my parents not registering or maintaining the land .
im so gutted.
I'm afraid to say I know of someone who had this happen to their land a few years back, again elderly, but there was no notification sent to surrounding parties in this case, so they had no idea it had happened! They were unable to claim it back unfortunately. It was what spurred OH and I to get everything voluntarily registered, as there was no prospect of us selling anything for many years and it going on the LR this way.
I hope you have better luck, as there are people who knowingly take advantage of situations like this. Keep us informed.

Think in terms of many months or perhaps years, then.
We have a land dispute going on involving our family via Land Registry and the claim is entirely spurious. It has still taken over a year so far, and the costs, involving specialist solicitors, you wouldn't want to know about!

Apparently not hethmar, they have said its for them to monitor and maintain their own land.
Apparently the new registered owner also has a'title indemnity insurance property' too. to cover me contesting their rights. :-(
All that means is that they have taken out insurance to cover the costs of pursuing a claim should someone else (you) claim the land to be their own. This is quite common with land previously unregistered.
It may mean that, should they eventually lose, the insurer pursues them for the costs paid out, as they knew full well when taking out the policy that they were claiming someone else's land.
In fact, if you can find out the insurer it would be worth a letter to them expressing surprise that they provided indemnity to someone who knew they were claiming someone else's land. If they then contact the insured and query it, the insurer may decide th cover is invalid and your oponent will be left to pay their own costs.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Ohhhhhhhhh, Id be spitting.
Check your insurance/employment etc. policies and benefits to see if you are entitled to free legal representation. Most house contents insurances have it as a tack on thrown in free.0
