Hubby has a speeding fine

The violation says "Speed 1:40". What does it mean?
I'll never be a Money Saving Expert while my kids are Mony Spending Experts.

    I think you may be thinking of https://www.pepipoo.com I think that unfortunately there is very little you can do to challenge these tickets, generally people will say that so and so down the pub got out of a ticket by doing a,b,c but it seems that all the loopholes have been closed and if the OP's husband was driving then it may be better to take the fine or hope to be offered a drivers awareness course.

    You can I believe request to the camera's calibration certificate if you are concerned about the accuracy of the camera, however I am unsure about how you go about doing this, again pepipoo should be able to offer you some guidance on this.

    England is different from Scotland but yes I believe in England no speed limit signs on a street-lit road means 30mph unless signed in England- and unless there is an error in signage that is the only way back.

    You should find on the picture a data-box super-imposed onto it. The databox in this instance for speed camera states Speed 1 and Speed 2. From memory speed 1 is vehicle speed, and speed 2 is camera speed. If the camera is stationary it is 0!

    The way to check is to go to the camera. Measure distance between white road markings- you know the time is 0.5seconds between photos, so work out how many markings the vehicle travels in that time, that gives you distance then do distance over time and work out how fast you are going.

    Two vehicles in shot can invalidate the FPN. Better to take this to the aforementioned forum.

    I agree - go to pepipoo.

    If your hubby didn't know where he was supposed to have been speeding, it's possible that the locus was not clear enough on the NIP.

    This is, with the greatest of respect, very bad advice. I am that man in that pub.

    There is plenty you can do to challenge these tickets, and in this particular case, if there are two vehicles in shot, it's a complete no-no as far as admissible evidence is concerned.

    The OP should NOT pay any fixed penalty or go on any speed awareness course, they should elect to fight it in court, where there's a good chance it will be dropped once the "evidence" is properly examined.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    I can see from your signature that you have been very successful in challenging speeding cases. However in my experience from the car forums I frequent people have challenged tickets gone to court and wound up worse off generally with larger fines and a day off work etc. Maybe this is because they lack the knowledge required to challenge these cases sucessfullly. That is why I suggested as I did not to challenge, perhaps that is defeatist :confused:

    In the snappily-titled ACPO Code of Practice for Roads Policing Enforcement Technology, section 16 (page 77 of 110) it says:

    "A close examination should be made of the film by the operator with a view to ensuring it gives:

    • Clear and unambiguous evidence of the offence.
    • A record of all the information required by type approval.

    Where there is a suggestion in the image that two or more vehicles are, or may, be in the measurement field, the reading must be disregarded."
