Advice needed

We have a pool car that is used now and then, today we got a speeding tick for the vehicle, 36 in a 30.
We have asked for a photo as we dont know who was driving, it could be me or two other people.
If I get a fine, can I ask the company to pay as it was in company time and I was doing the company a favour by dropping off some items that I dont normally do. As this is my first conviction (if it was me) can I go on a speeding workshop to hold off getting the points. If so how do you get on the course.

    Whether you're offered a speed awareness course or not depends on which area the alleged offence was committed. Where was it?

    The company now has to respond to a S.172 request - i.e. name the driver. If they are unable to do so, the company itself will be summoned to court and fined for failing to comply with a S.172 request. There won't be any points (obviously).

    Or, if a driver is named by the company, it then becomes that individual's responsibility. For 36 in a 30 if a speed awareness course isn't offered it will most likely be a COFP (i.e. 3 points and £60 fine).

    Of course the driver (if identified) could ask the company to reimburse the £60 (as a private arrangement) but the points will still be added to their licence.

    You will probably be better off going to www.pepipoo.com as that's a specialist site for this sort of issue. :)

    Did the company give you instructions to break the speed limit?

    If the company instructed you to jump off a cliff, would you?

    As a driver, you are responsible for the vehicle and how it is driven. As a result the driver is liable in the case of any prosecution.


    Btw, perhaps have a word with your employer about keeping proper usage records for so called pool cars. Not only would it help you know who was responsible for the vehicle at the time of the alleged offence, but HMRC are cracking down on pool car usage as many use the term to avoid benefit in kind taxation.

    However, I think you know who was actually driving at the time of the alleged offence. You obviously have the time, date & location of the offence, and you already admit you were "doing the company a favour by dropping off some items" at that time.

    we as a company did this before in a previous company...

    just reply dont know who was driving etc... send photo... 9 times out of 10 they never follow it up...

    number 10 thou company got 750 fine... :-S...

    Premier I totally agree with you.

    When I first read the above quote I wondered if I was seeing things!
    It wouldn't even enter my head to ask the company to pay MY fine if caught speeding just because I was in company time doing them a favour.
    IMO no-one is responsible for you and your actions when driving except you.

    How is that an excuse?! You should get 3 points and a £60 fine just for saying that.

    I'm very surprised the pool car isn't signed out. I thought this was standard procedure.

    As others have said traffic offences are down to the driver. Evenn police officers have to pay a fine/take points if they are caught speeding and their actions were not authorised.

    I went to court years ago for a speeding offence.

    There was a biker in there too, he was found guilty, 6 points, can't recall the fine.
    After he had been weighed off in the dock, he asked the Judge is he could be re-reimbursed his travelling expenses for attending court.

    It was the best laugh of the day.

    Friend of mine is a bus driver. After finishing his shift late one night he drove at speed back to the bus garage so he won't miss the last bus home. He was followed into the garage by the police who clocked him doing excessive speed. The bus company paid the fine and he had penalty point added to his license.

    Police would have let him off if in his own car but being a bus driver he is classed as a professional driver and there is zero tolerance in this case.
    Problem with having access to internet is that i get asked by many to solve their problems :( Well at least i learn something on the way :D

    Our Chief Constable was caught speeding-oh how we laughed!!!
