Capri Skies bridal boutique in administration -please help!

Options
Hi all!

I'm not a Capri Skies bride, but I just feel so sorry for the brides affected, and having seen such great advice on this forum I was hoping someone could offer some advice!

Basically, this bridal boutique 'seems' to have gone into or is headed for, administration- the stores have been locked up, stock appears to be missing and the owners are AWOL, staff have not been paid for ages and it's all a mess.

Many brides have dresses stored with them that have already been fully paid for.

If the co. does go into administration, will these brides get their dresses (presuming the administrator gets possession of them)? I don't see that they could be sold as the company's 'assets' if they are the property of the brides but I don't really understand the law surrounding administration!

Also, am I right in thinking that if the deposit for the dress was paid on a credit card or via Visa, then a claim can be made for the WHOLE dress cost, even if the balance was paid by cash/cheque? I wanted to clarify before I tell anyone and get them excited, if I've misunderstood.

If anyone can offer ANY advice or wisdom I know it would be appreciated, there are a lot of very confused and distressed brides this weekend!

about caiming the whole amount back....

the answer is yes to partial payment on a credit card (deposits etc)

as for visa's chargeback on debit cards, i dont know

and as for claiming the dress back, i would assume the admins will sell it on as assets in which case a purchaser would have to claim a refund. thats my understanding of that but i may be wrong
    Back by no demand whatsoever.

What I don't understand is how the administrators (if there are any, latest rumours seem to suggest that if they were going under administrators would have been appointed by now and they haven't been, the owners may just have done a bunk) can sell on goods that have been paid for by the customer as the company's assets. Surely that's theft?!

I bought a sample dress from Capri Skies just last weekend, and they were storing it for me as it needs alterations. That dress has been fully paid for, it belongs to me, not Capri Skies. If it was a storage facility gone bust, surely the administrators wouldn't be able to claim everything in storage to sell on? It's the same principle here, is it not?

You will need to find out who the administrators are for Capri Skies - one would hope that a notice has been placed by them on the front door for people to read. If you can prove that you have paid in full for a dress that is now being held by the shop for alteration then you need to contact the administrators to let them know that this is the case.

It may help if you contacted the local newspaper to say that you have paid for a dress and the company has simply shut up shop leaving you without a dress for your special day. It may be that they will do a feature on it and that way you may find out who the administrators are.

I found this on a wedding chat forum today - it gives links to the BBC and Clyde Radio.

Hope this helps and good luck. It makes interesting reading and it looks as though brides are getting together to sue the owners of the shop to prevent them doing anything like this again.

A dedicated chat forum has been set up for customers of Capri Skies (it has been set up by one of the customers affected), it might be useful. https://www.capriskieshelp.freeforums.org

    Hi all,

I feel terrible for all the brides are going through this it's horrid. I think the branches of capri skies are owned by Bryce Curdy's daughter. If you haven't heard of him he was a announcer for STV and also worked for West Sound Radio in Ayr. Funnily enough he actually has a website dedicated to providing wedding services and also mentions capri skies as one of his affilites
    Worth a check out.

  • Capri Skies IS NOT going into administration. This is because they are classed as a 'sole trader' company and because they are not registered as a Ltd company they do not have the option of going into administration. I believe the only option really is for the owners to declare bankruptcy, yet the Cameron's are maintaining for some reason that they are going into administration. I am not sure if this is down to stupidity or barefaced lying.

Hi Fadedpages, have you been in touch with Panache? they were dealing with distributing the dresses that were actually in the store.

I think this is because they are trying to say that they have insolvency practitioner looking at things. In practice someone who is doing the same thing as "an administrator". They should publish who this is though.

My son and i have both asked them to clarify what they mean by administrators being called in this week. So far both emails have gone unanswered.

I have to say I have my doubts over this and have sent down 3 newspaper reports and one report from Ayrshire Trading Standards to my son's credit card company to confirm closure and request refund under section 75.

If that fails I will send the statement from the Capri Skies website and the email from Mrs cameron claiming that administrators will be in place this week. This will go to their complaints department who might have someone who actually understands section 75.

My future daughter-in-law's dress is currently with Panache but she has to pay for it all over again (having already paid Capri Skies in full). It will be slightly less than the Capri Skies price though.

So basically waiting on cc company to play ball.
