Incorrect CCJ on my record!?

Options
Hi,

Let me filly uo in. 2 years ago (Dec 07), I was involved in a minor collision with some council scratters 50p nissan micra. In all honesty, it received a 2cm scratch on the bottom of the bumper as it was only a low speed incident. I offered the guy £200 (which in all honesty was worth 4x more than the car!) on the spot not to take it through insurance, or he could take it to any body shop and I would foot the bill.
What an a***hole, still claimed off my insurance. All fair and well, it's within his rights I suppose. All this was cleared up and my insurance company paid out.
A year later (January 09 to be precise) I received a Court summons!! He wanted £1800 + Court costs etc (so in total, just over £2k!) because apparently some items were damaged in "the collision".
So I sent the letter off to my insurance company but because the claim amount was so small, they paid out again  Even though I had pictures of everything, including the damage to his car, witness statements etc.

Anywho, a few days ago, I thought I would check my credit score and guess what, I have a CCJ against my name! Thinking about it, the letter I received was sent around the 20th of December or thereabouts but I only got it sometime in January 10th!! I wrote a letter to the court to inform them of this and the claim will be settled through my insurance but received no reply even though I sent it through registered post and the letter was delivered!

So how do I get this removed as it has been paid out anyway!?

It will be removed automatically 6 years after judgement.

Unfortunately a judgement against you does not get removed when paid off merely marked as settled.
You can make a written correction on your file if you think it is worth it.

The only other thing you can do is write to the court to see if they will set aside the judgement.

If the CCJ is settled within 1 month, you will be issued with a notice of cancellation & it will be removed from your credit report.

If I were you, I'd want to find out if your insurance company was contacted with regard to the 2nd claim before the court summons was issued though. I should think they would have been if the inital claim was dealt with via the insurance.

If they were contacted and failed to act on the claim, you can ask them to send a letter to all three agencies informing them that the CCJ on your report is their fault and you shouldn't be penalised. The CRAs will then remove the CCJ from your report.

    Hope this helps :o
