    Like I said before there is a very good chance they will get off the charge as the circumstances are so "He says she says" in addition your friend will not be a very credible witness so a good solicitor will tear holes in the case. To gain a conviction it has to be beyond reasonable doubt.

    If they are not convicted the passenger will have a reasonably good chance of getting the compensation as your Insurers will not want to through money into defending a legal case if they think there is a reasonable chance they will lose

    If they are not convicted and Axa don't pay out you could try sueing them in a county court as the onus of proof is not as great, although there is no gurantee thye will have the funds to pay her back.

    I sort of guessed that...I feel really sorry for her, she was trying to do the right thing...I hope she will be philisophical about it and try and move on...at least they are offering her a renewal even if over-inflated price...she can at least hope they will be convicted...I think one of them has owned up (not the injured one) which I think her insurance is aware of(from the Police reports), hence the quote..Do you think if she tells all the details to someone like Quinn they might be more competitive?..surely its worth trying a few other brokers

    I would suggest she bites the bullet and renews with Axa, waits to see what happens with the claim / conviction and then changes company at the next renewal. This will give time for the claim to go through (Either settled or declined.

    If she goes to a new company now she has to declare the claim as unsettled and they may ask more details about it. If they discover the details they may decline to offer her cover which is sometimes noted on central databases. If you have had Insurance refused or declined you also have to declare this and it can be very difficult to obtain cover again.

    If she renews with Axa its likely they will just register the claim as a normal claim and then when she transfers next year she just needs to declare a claim.

    By the way I would give Quinn the very very big swerve, they would certainly have not paid out on her current claim. They investigate claims very throughly and if they can reduce what they pay on a claim or refuse it they will do it.

    The things Insurers do not like are fraudulent claims and policyholders who lie to them, she should learn from this mistake. Like I said before she was lucky she was with a reasonable Insurer such as Axa.

    In a couple of years it will be water under the bridge and her premiums will be normal.

    I'd investigate taking a civil action against those nasty morons she calls friends and claiming compensation for the costs she's now liable for and the distress the situation has caused her. The driver will likely be convicted because he's admitted it but that doesn't make up for the increased premiums which, over the years will likley amount to many thousands in excess. Damn, if someone had done that to my car I'd be in the news.

    Insurance companies share details like this these days.

    Filed a fraudulent report. With this in mind and the passenger filing a claim for injury could be seen as more fraud had been planned.

    Problem will be, have you had insurance cancelled or declined which the answer will be YES, getting insurance with that box ticked will be harder.

    If they lie then then might not be insured when a claim is needed.
