Could someone please help me.

Today i received a default judgment for claimant from the county court.
It is for just over £1000 and i have no recollection of the debt.

The claimant is Observices Parking Consultancy

I cannot find any contact details for this company on google and there is no phone number. I have been never received any parking notices from this company and never received any court papers about the claim.

And now i am served with a default notice.

The first payment according to the notice was due on 28 May.
But i have received the notice today.
So i guess the next thing they will do is send a bailiff.

I do not owe this money, never received any notice for this how can i dispute and what should i do now....to try and resolve this.

    Hi there Hummy, if you dont agree that you owe this money, you can make an application to the court to have the judgment set aside. The form you need to complete is N244 and there is a £75.00 court fee to pay unless you are in receipt of certain benefits or have a low income, see here for more info. If it is not already at your local court the case will be transferred when you make an application.

    Thanks i'll check those links out and see what i can do. The thing is this is a default judgement so can this be set aside? I mean you say about it going to local court but i already have a judgement from northampton court.

    Yes you can make an application on a default judgment - it will have been granted automatically in the absence of a defence. Northampton is a bulk handling court for the major claimants (such as banks, utilities etc) and is also where the online claims are dealt with x x

    Also be sure to read the many posts about Observices over on PePiPoo.com (a site dedicated to helping motorists in your situation) which suggest they are a bunch of thieves and scammers, not averse to telling lies and other sharp practices to frighten money out of you!!

    So can these companies just lodge a court case and get judgement without ever contacting the would be defendant? Don't the courts automatically send a copy of any claims lodged with them?

    Hi Poppy - a claim form would be sent by Northampton 1st class to the address that the claimant has provided for the defendant. Unfortunately it is not financially viable to send them recorded so there may be instances were people don't receive the claim form. This however is not a sufficient reason alone to have a judgment set aside, the defendant would also have to show that they have a reasonable prospect of defending the claim. x x
