I'm enquiring about a "hypothetical" (;)) situation that is really starting to drag...
Quick outline - shared house of 5, plus one single spare room. No signed contracts but given rent book. Notice is one month either way. Landlords are brilliant :j
Landlord goes away for a week, landlord's relative lets out the spare room! :eek: We were "asked" one evening (as in, it had already been decided so there was a smart comeback for every query/objection raised), person #6 moved in by the next evening. Landlord's relative said it was temporary until they found somewhere else (we think a sob story was used).
Person 6 has not paid any bond/deposit, has no rent book or contract, did eventually pay rent late, hasn't even MET landlord, is not looking for other accommodation, treats the place like a complete dump, and is so loud they can be heard talking in every room in the house. :mad: Oh, and has had "friends" overnight without letting anyone know!! :eek:
The house is too crowded in terms of seating space, showers, washing machine etc etc.
Landlord is understandably hopping mad! Has tried to make contact but person 6 is always out.
Is there anything that can be done to make person 6 move on? Like they were SUPPOSED to be doing...?
Am I right in thinking that now they're here, they can't just be booted out?

Have they got a key? If not, don't let them back in.

Serve a section 8 giving him 6 weeks notice due to upsetting other tenants and being late on the rent
Altho if there is no signed agreement and you changed the locks and all the existing tenants claimed he never lived there ...0 -
Most odd... the only way round this is for ALL of you to text the LL immediately the person is about/in, get the LL on immediate alert to turn up.0

What is a "section 8" please? Eviction notice?
I was unsure whether to keep in such frequent contact with LL as we know he has a lot on (family illness on top of recession probs) and is doing his best. I believe him and person 6 have left notes for each other, but its not the same as a face to face serious discussion.

OK, having to play 20 Questions here:
- is the house a licensed HMO?
- how many for?
With that many people in, a house is most likely to be deemed a House of Multiple Occupation and will have to comply with various regulations/requirements. There might not be enough showers/bathrooms.
Nobody's sure under what arrangement the person is staying there, if they've no agreement, they've no rights, so could be got out easily. If they have signed an AST (unlikely as the LL doesn't want them there) then they'd have rights to stay and a Section 8 is an eviction notice that still takes a long time (months) to get them out ...
My guess is this person has no agreement and makes the house illegal in some way.
The LL may have other troubles, but the quicker he gets this problem sorted the easier the rest of his stuff becomes as it's one less thing to do.0 -

Errr.... extended semi-detached, 2 bedrooms on ground floor, 4 on first floor. Two bathrooms plus another downstairs loo - which sounds plenty until everyone needs them at 7:30am...!
I think I should make gentle enquiries with LL. The trouble is they're almost TOO nice - they haven't batted an eyelid when I had to claim benefits (some LLs will not accept that), I know of other tenants that have been short on rent and allowed to make it up the next month and so on.
The LL has a few other properties too, I am *assuming* all licensed etc.

Um I would guess that if the person has no rent book, no contract, is a nuisance to legitimate tenants and the landlord did not give permission for the person to move in, that the landlord would be within his/her rights to change the locks while said miscreant is out (?) I know from experience what a nightmare it is living with dodgy co-tenants so I feel for you.
