You guys are always on the ball, so here goes.....
My Mother called today in distress because my Dad has accused her of committing fraud by taking out a loan in her sole name. He threatened to get the police involved!
My Mother has her own income and uses it for personal spending, joint groceries, joint holidays and her car. Dad pays the utilities (Mum gets a heating allowance for her disability which she pays him). There hasn't been a mortgage for about 20 years (the house is in dad's sole name).
Mum has no idea about Dad's financial position, and hasn't in 39 years of marriage!
Since my father "retired" (Dad works part-time) he has been putting more & more pressure on mum to reveal her income and expenditure details. Mum will not comply.
Lately Mum has noticed that Dad has been looking through her paperwork.
Last night he told her that he had phoned a "credit agancy" and found out that she is "default by six months", that the house has a terrible credit rating and that he had found out about her loan. This was when he told her that she had committed fraud by taking out the loan.
Let me clarify: the loan is in HER sole name, at bank that has NO connection to him, it is NOT secured on the house and it was used to pay off her credit card. Her account is run perfectly and she has NEVER been late paying any of her bills.
What Mum is worried about (apart from the obvious hassle that she is getting) is that he has been given information from a credit reference agancy about her.
Have i got this wrong or am I correct in thinking that a CRA can only give infornation about you & any JOINT information. Or can they tell my dad anything to do with any applications at his address?

i don't know about the CRA info, but no way has your mum committed a fraud if it's all in her own name!!!
It sounds like your dad is insecure about this money issue.Cats don't have owners - they have staff!!

He is a complete plonker because houses do not get credit ratings, these are associated with people, so there is no way her having a loan affects the house or his credit rating, even if she were in arrears. Ask folks who are married to bankrupts.
She can only get a default if the account is 3-6 months in arrears and they have written to warn her of this and she has not remedied the situation.
If he has obtained the information from a credit agency, this is in complete contravention of the DPA. Speak to the Information Commisioner. And she should also make a formal complaint to the CRA involved and demand compensation.
However, given the complete mish-mash of information he has given her, I think he has found out about the loan and has created a fiction which he is using to beat her over the head.

Feel really sorry for your Mum. Don't mean to be rude but your Dads sounds a bit of a tyrant. It does seem a little sad that they don't have a very open relationship on finanacial matters but I expect this applies to many couples. Your Mum hasn't commited any fraud by taking out a loan in her name alone. Think the days of having to get your husbands approval are long gone (thank goodness). Sounds like he's just being very mean and making your Mum worry over nothing. She's paying back her loan and she's got no need to worry.0

Yeah.. I cant see how either.. that they would have spoken to him on the phone about it. (it not being HIS credit/account)

It was in fact for my Mom and linked by name or address I'm not sure. Easily cleared up, but my Dad took out a loan using Mom's address (or maybe just one of a couple) and it showed on her credit file so she knew he'd taken it out.
However, these were people getting access to their own credit files not others. The loan MAY show up on your fathers credit file.0 -
I agree with RAS I think your Dad has found some information on your Mum's loan and has made up a story to try and get more information out of her. She has done nothing wrong at all. My Mum is 62 and my Step-dad is 76 and they keep their finances secret from each other. I think it is crazy but I expect it is a generation thing.Every day is a new life to a wise man.

It had my father in law.. and my brother in law on it!!
I have never had ANY financial anything with them.. never lived with them.. shared any thing.

Years ago that was true but parents were unable to remortage because junior had defaulted on an account worth £10. For many years now the credit check has been on the person not the address.If you've have not made a mistake, you've made nothing0
