Hong Kong seller making excuses not to ship - Help.

Hi all.
Won a sat nav yesterday at a very reasonable price. Within 5 mins of auction end the seller messages me with this:
So I reply with No I will not cancel as on other auctions he has 10+ Identical items on buy it nows so he has no problem with stock levels. At this point I request an invoice to reinforce the point.
Today I checked the listing and it said invoice sent, so I thought he'd tried it on, failed and all was well and paid via payPal.
Then tonight I get this:
I have replied no to cancelling the order and pointed out I have paid for the item and again pointed out the fact he has 10+ advertised and linked to them in the message.
Anyway I am sure this little weasel is going to stiff me if I don't play it canny, so any suggestions on what to do next as I am sure his next reply will be the same as the other 2.
Ta all suggestions appreciated.

He listed it at "99p NO RESERVE!!!" but then forgot to run his shill bidding software.. and now you consider you've bought it for his phony start price of 99p (or thereabouts) ?
Well.. you know the answer... forget about it.. if he won't take payment and send it, that's his prerogative.. he's already got his bluff in about it being "faulty".. so he's covered himself w.r.t. the ebay rules... i wouldn't try to force him... he could send you an empty box, a genuinely broken one, or... whatever..
you win some you lose some... and you've not actually lost anything... yet..0 -
if you did particularly want that sat nav from that seller, maybe you could explain how stressful this has all been for you, but how you understand his situation, and how you appreciate his honesty in checking the equipment for faults before sending it..
and.. furthermore, how you would still like to buy a fully functional navigator from him, but in a buy-it-now deal, and then suggest an ex gratia discount for the inconvenience you have suffered..
if he won't play, move on...0 -
Oh stop being so difficult and just do a mutual. Buy elsewhere.

Absolutely don't do a mutual, there is no way this is a mutual after all.
Personally I would not fight to get this unit now, I owuld have lost all faith in this seller. Your priority is to get your money back, once you have that back just report them as a non performing seller (point out that they are still selling other units) neg them with a well worded neg to really warn other buyers and forget them.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. HAve found out by some discussion that If I do a mutual cancellation he gets a refund on most of the listing fees. So agreed to this after he refunds me my money. Refund is now with paypal and confirmed.
Mutual Cancellation? NOT A CHANCE IN HELL. He wasted my time. I waste his money!
That's my kind of Karma and best served chilled.

I'd report him as a non performing seller with the emails he has sent you, and that he's basically fobbed you off.0

Good for you don't let people like this get away scott free.
I've sold stuff for peanuts but that's the risk you take with eBay and that should be the way of all sellers as in you win some you lose some but you play the game and most importantly as a seller you honour your sales.Always looking for a bargain and to help0 -
