Product Recall Rights- do any exist?!

Options
I recently toook some safety gates back to Argos as the manufacturer had advised me they were being recalled (they had my name and details as I had purchased the gate extensions direct via the manufacturer).

I did not have a receipt but did have a letter from the manufacturer stating that they knew I had purchased them from Argos since I had applied for the extensions. There was a 20 minute wait as they debated over whether I was 'eligible' for a refund. Their policy is that if you don't have the box or a receipt then you don't get a refund. This seems inherently wrong for product recalls.

I was eventually offered a refund of the lowest selling price which was way below what I paid for them (plus I had to buy replacements which left me very out of pocket). I can't find any information anywhere about product recall rights.

Anyone know anything?

I suppose the manufacturer or Argos on't know how much you paid for them as you don't have a receipt,so all they can do is to offer you the lowest selling price back.

Do you have any evidence of when you bought it (credit card statement, etc)?

yep it seems fair to me

id be inclined to find out what the fault was and make a decision on whether to return them or not.
    Back by no demand whatsoever.
  • Well that's two people think it is reasonable to accept the lowest selling price, so maybe I am over-reacting...... !

It's just been a big inconvenience AND the new blooming gates are not as good as the old ones!! I may still have the web reservation details which show the price.

Will probably take the new gates back and shop somewhere else though as the lady was also very rude (politeness costs nothing and this may have eased this particular situation).

    Thanks for the advice everyone.

the reservation will do nothing as it doesnt prove you bought it

hence the term proof of purchase

this could be a bank/credit card statement or receipt

f you dont have this your lucky you got anything

It is not proof but it is evidential.

How much difference in price are we talking?
