Can I ask my solicitor to enquire about bats?

    Occasionally it does make a difference. For instance I was told about a case where there was a stream at the bottom of the garden

    I think that kind of makes my point about the 'dance'. If a conveyancing solicitor has to relay on a 3rd party story to demonstrate an occassion when Enquiries have turned up something useful (ie has never turned up anything useful himself!) it shows how often it happens.

    It really is more for the solicitor's benefit than the Buyer: "at least we can point out to the client that we asked the question"

    Sorry Richard - not having a go at you personally, just at the conveyancing process/system in general!

    The point unfortunately in these blame culture days is that people can and do say "Why didn't you ask......?"

    They won't hear it if we say there wasn't any point asking that question because it wouldn't have got a sensible reply. It really is so much hassle because if something does go wrong the aggrieved client simply will not believe us when we say that a particular question would probably have not brought a sensible answer. It will be "How do you know, you never asked it...?"

    Yes, it was a third party story - I have had lots of cases where things have come up but they are generally much less significant/dramatic than the one I mentioned, which does illustrate quite well the admittedly occasional benefits of asking extra questions.

    As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.
  • where I work we had to get the "bat man" in to do a survery before we could start on building work - maybe worth you getting a similar survey done could be worth it in the long run,
