I agree. but the bank clearing time is completely irrelevant. A cheque is a bill of exchange, bank processing is not germane in any way.
I won an appeal with Islington as well,they said they received cheque after the discount period but when I checked when the chq cleared our bank it was only 4 days after the discount period and as that included a weekend i argued that they must of had received the chq before the end of the discount period.

surely the payment is made only once it is debited from your bank. Until then no actual payment has been transferred - you cannot make a payment if the cheque hasnt cleared???0

I would definitely appeal that, I don't think that, that is fair by any means. You paid and sent it, it's not you fault they recieved it later.

Read the Bills Of Exchange Act 1882. A Cheque is a Bill of Exchange, a negotiable instrument. Payment and Acceptance are two different things. Also see 'holder for value'0
