I will try and keep this as straight forward as possible .....
Husband just arrived home from sherrif court, been taken there by Clydesdale Bank for £3500 credit card, judge ordered open decree + court costs.?? (no idea what this means)
Bank with the Clydesale Bank.... 2006-2007 and 2007-2008 inccured £1500 in charges, havent added the rest up yet.
Husband self employed but cant find any work, i work full time, earning £903 per month approx.
Done budget sheet ...we have £122.41per month left to pay creditors and we have £27000 of unsecured debt.
Would we be able to claim back the bank charges due to hardship and pay his credit card of with what we receive??

I have to be honest and say that my knowledge on Scottish Procedure is not that good. I would look to claim back the Credit card charges to clear the outstanding arrears. However, whilst I would still claim back bank account charges, credit card charges would be seen as a non priority debt and so they may not payout on Financial hardship.0
