HELP! Nationwide refusing to pay hardship case!!!

Hi,
Please can anyone advise me if there is anything I can do about Nationwide refusing to refund bank charges?
I have been down the hardship route as I am a single mum living on benefits with debts of approx £12,000.
I am only claiming back £270 and thought they would settle straight away! However after reviewing my financial statement I had a letter this morning saying they would not refund as I have 'a surplus between my income and expenditure before making payments to creditors'!
Does this mean that they will not pay at all, or just not under the financial hardship rules?
What should I do now? Should I appeal their decision?

What they mean is that they will not pay out under financial hardship which means you have to wait for the conclusion of the OFT test case before they will pay out.Hi,
