Damaged item - Seller wants me to claim

Hi, I recently won a box of 100 plastic items on Ebay. I was particularly looking for 3 of the items, with the rest as a nice bonus. When the parcel arrived the packaging was appalling. The box was an old keyboard box, and the items only had a single layer of bubble-wrap as protection. Hence one of the 3 items I wanted was broken, and another had a minor crack.
I want to keep the undamaged and slightly damaged items, as well as the bonus items.
I have contacted the seller, giving as full an account as I can, including photographs. 5 days later I have received a reply from the seller telling me that I will need to make a claim from the Royal Mail, and he will help if I need it.
I don't think it's my responsibility to make the claim, and I'm happy to explain this to the seller. Not sure he'll agree though.
Anyway, if I make a claim via Paypal I will need to return the goods to the seller. I paid £41 for the items, with £5 for postage. The actual cost of postage was £5.41. If I return the items and damaged packaging I estimate that the postage will be somewhere in the region of £9+. I will need to supply proper packaging, send it recorded, and add additional insurance (that part is debatable).
This is a bit of a no-win situation. If I return the goods it could cost me £9. If I acceot the goods, part of it is going in the bin. If I ask for a partial refund from the seller they too will be losing out.
Any advise gratefully accepted.

you might want to change your title to "Seller wants me to claim"
yes it is the sellers responsibility to claim
start a paypal dispute, return the items when they tell you to, and by a trackable method and you will get the £46 back (£41 for items and £5 postage) but you will lose the return postage0 -
It's the sellers responsibility to ensure safe delivery I'm afraid. Why should the buyer be out of pocket for something that they had no control over - they just paid their money, and expected to receive the goods in a decent condition.
You need to handle this delicately, otherwise the buyer can simply open a paypal dispute for Not As Described, and you'll end up having to refund the whole lot.<--- Nothing to see here - move along --->0 -
I'm guessing the £5.41 was standard parcels 0-2kg rate, plus £1 for insurance up to £100
you would need to return by special delivery at a cost of £8.65
i doubt the seller will be able to claim for damage if it was due to insufficient packaging though0 -

The OP is the buyer. He put buyer in the title instead of seller. He has also written buyer instead of seller in his first post.
