Warranty sticker damage on new product

Hello, I'm new to the board and was wondering if anyone can give me some advice.

I've recently bought an external hard drive from amazon, when it arrive I noticed that the warranty sticker on the product was badly damaged (however not entirely broken) for that reason I've asked to return the item and receive a full refund. Amazon sells this product through a third party, although this isn't clear when you buy it, and I have to deal with the third party when returning the product. The third party company has asked for a picture of the damage which I have supplied, I'm concerned that they will say that because the sticker is only partially broken and not totally broken they will not refund the product, but I'd bet if the thing breaks down and I try to send it for repairs under warranty the manufactures would say the warranty is void due to the damaged sticker.

If they do refuse to refund me because they feel the product is fit for purpose, is there any way I can force them to refund me the money? I’m not sure the 7 day “cool off” period will apply because the packaging has been opened.

Any advice?

    Reject under the Distance Selling Regulations .... no reason .... but you may have to pay postage back - not sure - do a search on DSR

    Needs to be done in writing within 7 days of recieving goods ... check what your contract says about return goods.

    As I feared they emailed me with the following:
    Hi,
    The warranty sticker is fine and the product is still under warranty from us and the manufacturer.
    That is the entire email, no contact details including the name of the person sending the email. I’m still concern that if the drive goes tits up and I send it for warranty and it gets rejected I won’t be able to use this email as proof that they took responsibility for the warranty of the item.
    I’m tempted to ask them to send me an official letter stating that they guarantee the product is still under warranty and they will cover any costs and replace the item if the manufacturer refuses to repair the item during the warranty period.
    What do you guys think?

    I guess you should have made that tear a little bit bigger to avoid confusion. In the interests of clarity, or course ;)

    Choose your battles:

    a) for piece of mind, you could return it at your cost (as previously suggested) if the retailer is telling you that there is nothing wrong or,
    b) retain the email you sent with the photo and their reply - print a copy off with and store alongside the receipt for safekeeping, and use the hard drive. In the event of a fault (and hey, lets try and be optimistic), your contract is with the retailer and they have advised you that warranty sticker condition is not an issue. Thats on record and could be used if there was ever a dispute.
