Should I go to step 3?

Hi, I`m stuck with what to do next with reclaiming bank charges, I sent a letter asking for the charges to be repaid and got the standard reply of the charges are on hold, should I wait for the outcome from the OFT or should I go to step 3 and threaten court action?

I hope someone can help.
