Retrospective consent for conservatory in scotland-how long does it take?

Hi all

Looking for some advice. We are looking to buy a house in scotland. There is a 15.4 sq m conservatory with no consents. Don't think there will be any issues due to where it is and the size of garden, proximity of neighbours, etc.

Does anyone know how long it takes for the local council to provide retrospective consents? Not sure if it will be planning permission or a building warrant. We want to move in within 2 weeks but not sure if council will react this quickly.

Going to google but though I would sound out anyone on MSE who has been through this.

    Are you sure it requires any?

    If it was built a while back, it could have been built as a 'permitted development' at the time. Even though the regs may have changed since, if it was allowed then ....

    Unlikely to get a council to react this quick, but that could depend on the council - which one is it?

    The conservatory was built 16 yrs ago. Seller said no consents were needed at the time. The surveyors who did the home report for the seller has told my solicitor that as the conservatory is 11.5 sq m (previous size I stated was wrong) and patio doors have been installed (change to original building), it is possible that retrospective consents may be needed and enquiries may be needed with council. It may be that they do not need anything and this is obviously what I am hoping for.

    It is Perth & Kinross Council that the seller will be dealing with. Just wondering if worst case senario that consents are needed, how long does it normally take.

    Worst case (if for example a conservation area, a really dumb/ugly conservatory and an aggressive planning department) would be "Knock it down". Well, you did ask..

    Thank for for that frightening thought. Fortunately, I don't think there will be an issue with getting consents due to the area, size, design, proximity of neighbours, etc. I only worried how long the council will take to process a straightforward application. Not sure if they will need to visit and if they will put any urgency on it.

    I am hoping that it doesn't need consents at all.

    You say you're moving in two weeks?

    When was your offer accepted, when did you conclude missives (assuming you have already)?
  • Haven't concluded yet, awaiting the consents before this happens. We are ready to move, seller is ready. Everything else has been settled. Solicitor will reply formally to allow conclusion after consents are sorted out. Mortgage offer will be through for us this week. The seller will have no mortgage (downsizing).

    Don't think there is anything else holding either party up other than the issue of the consents.
