Advice please, bit long!!

Arrrghhhhhh

Long story, bought something of a forum, two days later received something completely different.

Messaged seller, no reply until the site admin got involved (seller done the same to two other people).

After some research, she has been in trouble in the past, taken to court 2-3 years ago for scamming people, and done it again last year. She changes her id all the time so not to get caught out.

After messaging her again, she tells me that it was mistake and that she sent the stuff to the wrong people. Said she would refund if I sent the stuff back. She told the admin one story why she didnt reply, then myself something different.

Due to her history, I have no guarantees that she will in fact refund me, in the past, she has not refunded on return of the items. She will not pay for return postage, and I dont see why I should, it was her 'mistake', I did try to comprise and say we go halves and I pay for special delivery so I have proof she has her stuff back, nope she wont do that as she doesnt want to be £10 out of pocket for her mistake.

I paid by paypal, credit card funded. Paypal wont do anything as I have recieved something. Have opened a chargeback through my credit card.

She is threatning me, saying I have to send the stuff back, in the same condition it got to me in and at my own cost. She is telling me I have to do this in accordance to the distance selling regulations. I may be wrong, and from what I have found, the DSR dont apply as this is a private sale. Apparantly she has had legal advice.

What can I do? I dont want the stuff she sent me, (a bundle of smoke smelling, stained clothes and four filthy, scratched dvd's, I paid for a DS Lite!) I just want my refund.

Do I really have to end up out of pocket for her mistake? She says paypal have put a hold on her funds, she will refund me when she gets the stuff back, again how do I know she will do this?

    This is a difficult one, as you say there is no paypal protection as paypal does not cover SNAD claims unless on ebay. I also worry that your credit card company may also refuse to help on the basis that (I assume) seller can prove they sent something to you, so ti is your word against hers as to what she sent.

    All I can htink of at the moment is a combined small claims action along with the other forum members who have been ripped off.

    I don't personally believe for a second that she's done this by mistake. I don't believe that anything she's ever done has been a mistake. I'd be inclined to get together with the other ladies that have been scammed by her, compare notes, and as soolin says, look at launching small claims action against her. I seem to remember hearing about the police being involved the last time, although I could be wrong. Try to speak to someone who was taken in by her the last time and see what happened, and what was done back then.

    Indeed you are right, it is her.

    I will look in to small claims against her, she is in Scotland though.

    She has no proof that I have anything from her except for the pm's we have shared. She did not send anything recorded.

    I have pm'd the person that took action against her before, hopefully she will reply.
