Can I Claim Mis-Sold Gap Insurance back?

Hi

I did have car finance for two cars with Yes Car Credit aka Direct Auto Finance, I feel I was pushed into signing up for GAP insurance and Breakdown Insurance/Warranty that I did not need. The salesman stated that if I didnt sign for it I wouldnt get credit for the car. Reading trhough the PPI reclaim I feel I was MisSold both these insurances. Can i claim these back or is it just PPI you can reclaim?

    You can potentially reclaim any type of insurance like this in the same way you would do PPI.

    I have dealt with complaints that have been successful yes so don't worry about it and give it go :D:beer:

    DAF have stated as they were not authorised by the FSA at the time of the sale then I cannot claim to FOS is this true? They state that as I signed the agreement then I am bound to it and that i have provided no evidence that the sales person was pushy or stated that it would help my credit, which he stated that it would help me.

    I am not sure what to do i have issued a second letter. But I have a really bad feeling that I will get no where.

    Technically that is correct. However, there is something going on at the moment which may alter that. No official announcement yet but people are saying that the FOS are now dealing with general insurance complaints from firms that were not FSA authorised. It may only be limited to PPI or lending but we dont have any details or confirmation yet.

    That is a fair response. After all you are making an accusation against that individual. Anybody can say anything happened. Many claims do see the consumer tell a pack of lies to capitalise on loop holes (especially with template letters). So, if you have no evidence of wrong doing they have no evidence of wrong doing then there is no reason for them to agree with you. You do have to give them something to go on.to show that on the balance of probability, you are in the right.

    But I dont know what else to do, I really did feel pushed into it, the sales person even said he had no finance background. I really feel like I shouldnt have started this if im going to get nowhere :( What else can I give them to go on. I know i am not lieing and can see where your coming from.
  • hi everyone ,i am also having problems claiming back my ppi.
    i contacted blackhorse who the finance was with and they told me to contact the dealership to which i could'nt as i bought the car at dixons who have since gone bust.
    i sent another letter telling them this and that the statement i was sent said STATEMENT OF ACCOUNT FOR 31ST MARCH2006-30TH MARCH 2009
    HIRE PURCHASE AGREEMENT AND INSURANCE LOAN AGREEMENT NUMBER 133XXXXXXXXX and that i also recalled the salesman stating that i needed to protect my payments for the finance to go ahead.
    they then sent another letter back with acopy of my agreement saying that there has never been any payment protection for this agreement but yet on the copy i have recieved of the agreement the box for gap is clearly ticked and i have my signature in the said box to agree to it.
    i have also now recieved a letter stating that and i quote" as this product is for the purchase of a GAP insurance product we are unable to cancel this from your loan as it is not a Black Horse product.Only the selling dealership can can cancel this type of policy."
    i dont know what else to do now and was hoping someone could guide me in the right direction with this issue.

    I need some advice. I bought a car on finance 7 years ago. I was actually sold Gap Insurance without realising it until recently. The car got wrote off in 2006. I eneded up having to pay the company approx £6000. They never mentioned that I had this insurance on my policy when I rang to tell them about the car. Do you think it would be possible to get my money back even though it so long ago?
