Senseo, recalls and the retailer

After the product safety recall on Senseo coffee machines described here

Over the past 5 weeks, I have had no luck in getting Philips to honor their recall obligations - despite confirmation that my machine is one of the affected batch.

My question is who is liable for the sorting out the repair - is it the manufacturer (Philips) or the retailer who sold me the item ?
