anyone had dealings with triton credit magement?

Hi Everyone
Just wondered if anybody as had dealings with trton credit management? iI defaulted on my natwest lon and overdraft and in december recived a letter fom triton re my debt,i cameto an arrangement to pay £259 a month for a debt of £33000,it was more than i could really afford but agreed to it,ive been paying since then,but recently been off sick for 3 months and my income has dwindled and finding the payment a struggle,this month i find has not been paid,i set up dd but they havent claimed it but its probably a good job as the moneys not there.
My main concern is that ive not heard from them and another payment is due soon which i cannot pay until i next get paid in 2 weeks,what are they likely to do,will they call at my house or something and threaten me? i just dont need the extra stress ive been through so much lately and anoter knock is sure to tip me over the edge,any advice would be greatly appreciated.

    1. Make sure you're claiming all the benefits you are entitled to.

    2. Make sure that the priority payments are covered -rent/mortgage, council tax, elec, gas, food, tv license, car insurance (if appropriate).

    3. If you can afford to pay something to your non-priority creditors then send them a statement of affairs justifying that amount.

    4. Make payments by standing order, not direct debit.

    This morning recieved letter from triton dated 21st 1st 1 ive had about the matter asking me to phone them,if they hear nothing the account will be sent to their solicitors,so i was brave and picked up the phone to try and sort this out only to be told that the debt has gone to a debt collectors (i thought the debt collectors were triton),i asked wha do i do and she replied wait to hear from them she said they will turn up at my home for the debt and will instruct my wage department at work to have money tasken out of y wages!!!!!!!!!!!!!!!
    This is a nightmare im so so scared pleasecan anybody tell me what the worst they can do,i just want to come to an arrangement that i can afford and after having 3 months off sick from work and a reduction now in hours i cannot afford the £259 they were asking,the woman on the phone was not very helpful she said FACE THE CONSEQUENCES!!!!!!!!!!!!!
    if this means people knocking at my door hounding me for money i dont have,id rather end it all,ive been ill,nobody understands,i cannot eventype this lettewr due top the tears,please please somebody advise me what there going to do to me please help.x

    It may be best for you to report all of this now to the OFT.

    Don't speak to these people again. Others here will assist with what comes next.

    A Debt Collection Agency Says They Are Going To Arrest My Wages, Can They Do This?

    A debt collection agency does not have the power to arrest a person’s wages. This can only be achieved if the matter is taken to the legal courts and a judgement is made in favour of the creditor. Some debt collection agencies will make threats such as arrestment of wages even if they know they do not have the power to do so.
    From what I can see they have acted totally irresponsibly just on your phone call and also unlawfully. Don't listen to anything they have said on the phone. Now from what I can also see of what they've said to you they are falsely and misleadingly representing themselves just by saying 'we can take money from your wages'.

    This is unlikely to happen. If it does, don't open your door. They have no legal rights.

    The next letter is to help you take control of this situation, give you some peace of mind and regards threats of doorstep collections:

    Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date.



    Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.



    There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.).



    Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    Hi petal, just wanted to reassure you that someone will be able to help you, please don't despair.
    I don't think they can call at your house without a court order, and if they do simply don't let them in, or for that matter take money from your wages, at least that was the impression I was under
    As Merlin says don't talk to them again, they will only threaten you with all sorts, especially if they can see they are getting to you, they are just lowlife.
    There's ways to sort this out, just sit tight and someone will be along with some good advice.

    Edit - they can be acidicly vile as much as they want but doesn't change the fact they are acting unlawfully. ;)

    Petal, take a deep breath and take on board everything Merlin has said.
    Have you contacted one of the debt charities such as cccs for help with what to do, if not i would urge you too, they are briliant for non judgemental advice.
    Nothing is going to happen right away, even if it got to the stage of court that is way down the line.
    In the meantime I cant say strongly enough to you don't talk to them on the phone.
    People do understand what you are going through, it's tough at the moment but there is light at the end of the tunnel.

    Please don't let them get into your head like this. It's what they want from you and anyone else in this situation. When you are ready to ask more questions, ask away and someone will probably be around to answer or just be around to talk.

    Hi Petal, I am typing this hoping that you are still visiting this site

    I am new to this site and these guys are great, I am at the start of my journey BUT it will be my second one as we found ourselves in a situation just after we got married 21 years ago...................yeah I know, didn't learn the first time.
    The thing is Petal, its not the end of the world, no matter how bad things are, last time we came out the other side, bought a house which I never thought we would ever do. I was sat exactly where you are and even became a recluse, I was so ashamed, buying clothes was a nightmare, I felt so guilty. The tears and fear are all too familiar, even now I hate the postman calling.
    It will get better, just keep coming here, even if some of us can't help we can offer a shoulder to cry on
