Personally, I would send them the cca request and wait the required 12+2 days. If you receive a compliant true copy of the original cca, then you can make the F&F offer.

    Thanks again,
I will send the CCA requests tomorrow. Looking at the template CCA letters that others have posted but there seem to be different ones. Would you know which is the latest / best to use? (sorry, there probably is an answer already on the threads but I cant find it)

Remember to send a £1 Postal Order (not cheque) with the request and to Print (not sign) your name on the letter.

    thanks,
not sure about requesting "a full breakdown of the account including any interest or charges applied" The interest was stopped when I started DMP, 2 account than added some interest later for a period of time only. So for approx 4 and half years I have had an interest free debt.

Basically my concern is by requesting "a full breakdown of the account including any interest or charges", can they turn around and apply interest on the account for all these years and send me statements of the account with full interest? after all DMP is not legally binding.

Or should I remove the above from the template letter and just request the CCA only?

Also it says only 1 pound fee is required? should I send 2 pounds anyway?

Request the full statement - in the unlikely event that they do 'turn around and apply interest' then we will deal with that aspect if it arises.

Sorry about mistake on Statutory Fee - just send the £1. I have corrected my post.

    Afternoon All,
    just an update from me...
CCA requests sent to 6 creditors, 4 creditors received the letters on 03/06/09 and other 2 on 04/06/09 (delivery confirmed by royal mail)

Is it 12 days from the receipt date that they have to reply? thanks

It is 12 working days from receipt of the cca request, treblex - so allow 12+2 days.

Now.. is this too cheeky? .. (im still new at this and learning) :o

I have only recently started my (own) DMP.. and nothing is set in stone with anyone yet.

But one of my smaller creditors.. I have enough to pay them off.. Is it too soon to ask for and F&F? .. (im going to pay it off either way.. but I thought I might at least try to save enough to pay for my car windscreen..)

I'll take out a few details in case they are reading the forum.. :o

    Without Prejudice

    Dear Sirs

I recently wrote telling you of my financial difficulties. Asking that you accept my greatly reduced payments to you.
As you are one of my smaller creditors I am aiming to try to pay you what I owe you first.
My relative has said that they will pay a one off offer of £XXX towards my debt. For now I would like to pay this to you, and ask that you accept it as a Full and Final payment, that once paid closes my account with you.

If you accept this, could you please confirm to me in writing that you will accept this payment as a Full and Final offer, that you will not seek to get the remaining £XX yourselves or via a third party, and that if possible you will reply to me within 10 days or I will be withdrawing my offer and will have to pay it to another creditor, then can continue to pay you £X per month.
I would like to get my debt to you repaid.

Should you agree in writing to the above, I can pay you as soon as you reply.

    Yours faithfully

    ..
 yes? .. no? .. too soon? too cheeky? :o

(to be honest.. its only knocking off the 'odd' .. Its not much at all if I showed you the figures)

As I have only actually missed ONE payment with them.. (tho have told them of my DMP and circumstances) ..
They may tell me to take a flying leap.. maybe it IS too soon to get 'clever'.. :o
