Mis-Sold

GARY600
Posts: 4 Newbie
I bought a motorbike back in October and have had a bit of a bad
experience. When I went to have the bike reregistered I was told it was
already registered in someone elses name and had a lot of running around
to get it sorted. Now I have discovered that the bike isnt quite what I
thought it was and im a bit angry as i've just ordered service parts that I
now know wont fit :mad::mad:
When I went to look at the bike it was described as a 2001 CBR 600 F1
and it has graphics on it to that effect but after looking in the Haynes
manual I have discovered that is actually a CBR 600 FY which is a
completely different older style model that I assume was registered in
2001. I have also noticed that on the receipt I got with the bike it is
described as a CBR 600 FS.
Is there anything I can do about this ??
I feel a bit cheated that I have been sold something which isnt as
described.

Speak to a police Officer,preferably one from the traffic section.
If he can confirm it's not as described,then go to trading standards.0 -

What does it say on the logbook?"Love you Dave Brooker! x"
"i sent a letter headded sales of god act 1979"0 -
You could also do with providing a little more information such as was it purchased from a dealer, privately, cash, credit card etc...
Also if the plod can't help - you would probably get more info from either a honda bike dealer or via one of the online forums. I've no idea on the relative differences between the F1, FY and FS - sometimes the same model can be given a different model name depending on the country from whence it came?0 -
The log book describes the bike as CBR F and was bought
with a credit agreement through Black Horse which has it described
as a CBR F1 on the paperwork.0 -
You have extra protection by buying it on finance.0

No point in going to Trading Standards (TSS) unless you bought it from a dealer / trader. If bought from a private individual, then you would have a civil claim for damages for fraudulent misrepresentation. There is no offence for TSS to look at.
If bought from a dealer, then there is a breach of S5 of the CPR's for
(o) specification of the product; and possibly
(i) the method and date of manufacture of the product;
Tss will investigate such a complaint against a dealer only.0 -

You don't actually have extra protection. You have exactly the same redress as I've mentioned in the post above, it's just that as there is a credit agreement, then Black Horse will have joint and severable liability with the dealer.
Essentially what this means is that if you are getting nowhere with the dealer, you can make the same claim against BH, and they must deal with it as if they sold you the bike.
Relavant law here is the Consumer Credit Act, Section 75.0
