A month from being homeless but thats not financial hardship???

Hello,
I recently wrote to HSBC to claim financial hardship and requesting my charges back early as I am currently sleeping on a friends sofa and have no way of getting a deposit, first months rent & furniture for my own place as am in a DMP with the CCCS and have a credit rating of 0 thanks to Cap1! My friend is moving in with her boyfriend which will leave me no where to go at the end of June! HSBC have told me that because I have a deficit of £83 between my income & Expeniture that they won't look at my claim although I have explained to them that that £83 is my CCCS payment to which they responded 'that doesn't count as an expenditure!' Can anyone help or do I just give up now?! I read that I should write to them again but have no idea what to say as was told under no uncertain terms that I will not be getting my money back!
Any advice would be very gratefully received and appreciated..

They would have added "until the conclusion of the OFT test case". I think I can see how they came to that conclusion. Most banks' are looking at priority debt arrears(mortgage/rent. council tax, utilities). Because you have arrangements in place they are seeing that as being in hand. I'm not sure what to advise because in spite of what you have written, you may not be seen by the bank as being in hardship for the reasons I have given on this post and as they define the FSA Waiver.0
