Thanked 0 Times in 0 Posts Bus Lane Contravention Feb 28, notice sent out in MAY - sent out too late???
Hi Neil,
I saw this post of yours (below) about Newham Council sending out bus lane contravention notices out of time, which gave me the glimmer of hope I've been searching for through forum after forum!
Got a notice about a Bus Lane contravention - Barking Road just before the A406 turnoff - I was about to turn left onto the A406!
Contravention was on 28th Feb but sent in May which immediately made me want to check whether this was out of time. What is the time limit for the LA sending a notice? Where did you get the information? How can I check so that I can dispute it on the basis it is void???
Would really appreciate being pointed in teh right direction! You seem like an incredibly helpful forum participator!
THANKS SO MUCH!
thank you, I'm flattered but I really try to avoid private cases at the moment. In particular, i will not take a case off forum unless there is a particular reason, i.e. something near to my heart, disability or vulnerable people and normally will explain to the boardguide 'Crabman'
there seems no such particular reason in your case.
If you have already read the other Bkg Rd bus lane cases then you know it is winnable. In addition they have changed the markings, quite substantially, since your PCN.
When I get a mo I will PM you a relevant case from Adjudication where Newham were decisively defeated.
Is this car registered to you or lease/hire/mobility, etc??

Hello!
Thank you for your reply. I didn't realise you had replied, so sorry for the late response. I completely understand your PM/forum policy.
This vehicle is registered to me.
I sent a letter in the end saying it was out of time as it was sent after the time limit in a piece of statute, the title of which I can't recall at this exact time.
I stated that the PCN was unlawful in accordance with the statute and it should be immediately cancelled.
I sent the letter by recorded delivery and it was delivered to them. But I received no response. I tried calling on several occasions but always engaged and no waiting queue.
Now I have received an Enforcement Notice! I am really angry because my letter WAS received by Newham Traffic Enforcement (tracked the recorded delivery and it arrived) but it seems to have been completely ignored.
Any thoughts as to what to do??? It seems the only way to challenge the PCN now is formally, as discussed in other forums. But it is not even lawful!0
