Nationwide say not in hardship when got charges !!!

Bank: Nationwide
Amount claimed : £1700.00

Contacted bank back in march re financial Hardship case. They sent letter asking for incomes etc. filled in and returned.

They wrote saying they are looking at it and will write again in 14 days. as they promise to reply to first letter in 14 days and could'nt give a proper reply.

Got letter this week 6 weeks since we first contacted them say they can't refund charges.

Rang and asked why as yes we do meet crit etc....

Told "that as we did not tell them back in 2003 that we were in hardship they won't refund the charges. as not in hardship then :mad:

We did go in and ask about changing our account to one with a very small overdraft in case a dd was going out early (ie Sky) told no. That was in 2003, but that not proof enough NOR is they fact that thats when the charges getting bad.

"As we are not getting regular charges on account they are not making our situation worse". (we moved accounts as kept losing our money in charges)

Then had the cheek to ask if we can pay off the out standing balance?? It's only £275.00 all of which are charges in last 12 months.


Think I need to contact the banking ob but with which letter??

    Are you reclaiming charges on your current existing account provider?
    Do you have priority debt arrears(mortgage/rent, council tax, utilities)?
    My initial thought was I couldn't believe that they were being that picky UNTIL I spotted you don't use the account anymore so unless you have priority debt arrears then I kinda agree with what they have stated.

    EDIT: I'm not good at reading signature but does the BR and date mean Bankrupt on that date or am I missing something?

    Yes we have priorty debts rent and council tax, yes council was from when getting charges. Had to move our account for money coming in as they kept taking money from us in charges making it worse.

    I was made BR back in Aug last year. But it was a joint account, that Nationwide never closed OR asked for me to be removed. They were made aware of my BR and also had copies of rent arrears letter and gas arrears and council tax arrears sent back with the I&E form they sent us.

    If the account with Nationwide was included in the Bankruptcy then you will not get any of the charges back since you are not entitled to them. I would consult your OR because the charges aren't yours if they pay out. If the account wasn't part of the BR then ignore me.

    Near end of contract end of 2003, but still cheaper on basic package as get free broadband, phone cheaper than BT too. We don't drink or smoke that's waste of money if in hardship!! How many people do though??

    Nationwide NOT included in BR as joint account. So partner entitled to charge refund! It his half I listed as amount claimed.

    You'd be surprised. You have people who ask for charges refunds claiming they can not afford them yet smoke about 20 cigarettes a day!

    I had a lady one who wanted life cover and although she was a smoker her premium was only £5.20 per month. She says she could not afford this yet she smoked 20 cigarettes a day, a pack of cigarettes was the cost of her monthly premium. You get many people who are in financial hardship but waste money.
