Ebay item out of date by 2 & half years....

If an ebay seller sells something as new that is actually 2 & a half years out of date & a buyer points this out to them do they have to contact other buyers of the same item to get them to check their products?
I recently bought an item with this problem & after checking the sellers feedback I can see that this is the 23rd one of these that they've sold in the last 90 days.
I'm just curious about whether or not they have to check up on the other (same) items they've sold?

lol It was a gift that I bought for my friend who's getting married. She was joking (actually, she's prob not joking..... ) about joining the Mile High club when she goes on honeymoon & I saw a 'Mile High' kit on ebay that has wipes, a mirror, cinnamon breath mints, an eye mask on the top to refresh you during your flight & in a 'secret' compartment underneath that bit there's a small bullet 'toy', a tickler, some condoms, a bottle of lube & a bottle of massage oil. I couldn't resist buying it for her!!!! lol But when it got here & I opened it to check I noticed that the mints went out of date in December 2008 & the lube & oil went out of date on 31st December 2006!!!
Obviously I'm not giving it to her now! lol i just wondered what would happen about the other 22 that were sold?

There are some things I wouldn't buy from strangers on ebay.

Condoms are one of them. :rolleyes:

Email the seller and point out the problem and see what they reply.

lol they don't use condoms, it was more just the idea of the set & the fact that its all branded 'Mile High'.

The seller has now issued me with a full refund after I pointed the problem out & has said she will check her stock on Tuesday to see what the other sets are like. She said she only just 'took over' (?) in November & asked me not to leave a neg as she hasn't had any since she started. I'm not going to leave a neg as I've got my money back.
I just wondered what other people thought about whether she should contact the other 22 buyers or not? Its not like the items that are out of date could do any harm could they?
& she'd cause herself more trouble if she did point it out to all the buyers. I just know that if it was me I would feel so guilty about it that I would contact people to ask them to check their kits.

I wouldn't care about the OOD sweets or massage oil but condoms are made of latex, a natural material that deteriorates very easily, and I would NEVER use OOD ones for contraception.
