Abbey bank charges claim-partial refund query

I have put in a claim for about £2000 worth of charges with Abbey and have claimed financial hardship. They have agreed to refund £400 given my circumstances and have sent me a cheque! YAY!!!! Nowhere in the letter does it say this is a final settlement or anything. I'm wondering if I accept this amount and pay it into my bank can i still pursue the rest of the charges I have claimed for or if I pay it into my bank does this mean I am accepting this as a settlement?

Sorry if the answer to this is posted elsewhere, I did have a look but couldn't really find anything.

    It should not affect your claim. It will just be deducted from any final figure after the conclusion of the court case.

    Banks cannot offer full and final settlements of bank charge claims.

    The bank cannot offer a full and final settlement of bank charges until the OFT test case is completed, so therefore, you can get the rest back.
