Pay cut.

Just found out that I might have to take a pay cut. Its likely to either be that or redundancy. I know about the constructive dismissal thing if I object to it but if I decline the paycut do I have the option of telling them I want redundancy? It will be around £12k a year reduction. It costs me around £3k in petrol a year just to get there. I would rather take redundancy but not sure if I would be entitled to say that I wanted it rather than a pay cut. Any ideas?:o

I would just refuse the pay cut. They then make the decision on whether to dismiss.

I guess the constructive dismissal possibility here would be if the employer refused to make O.P. redundant and imposed the paycut - at which point O.P. would consider resigning and saying they were "constructively dismissed" - due to terms/conditions of the job being different/worse to the job they agreed to take on in the first place.

I don't believe the employer is allowed to arbitrarily impose the paycut without the agreement of the employees affected.0

The employer could simply take the OP down the change of contract route. After a period of consultation which would be similar to redundancy..if the OP doesnt agree to the change of terms and conditions then the employer could give notice to vary contract...after the notice has expired the OP then would have no job if didnt agree to change...its cheaper than redundancy for the employer and if they have legal help...they will have the knowledge to do it.0

Thanks weths. I was hoping I could just take redundancy instead. Its only government minimum but Id prefer that than dropping by around £12k. I should find out next week sometime. Im going to stick to my guns and say no then see what happens next! Thanks again for all advice.:smileyhea0

Out of interest, what's the scale of the reduction?
Is it £40k to £28k or £70k to £58k?
We all just had a 10% cut!0
