Long Term Sick

First of all hello,
it's my first post here, i've been off work with a bad back from Nov 07. I have had a severly bad back for about 6 years but went to my work with the help of a lot of painkillers. I had surgery on my lower spine for 2 bulging discs and spinal stenosis back in April O8. This did nothing for me apart from make me worse, since i've been off work i can't walk without crutches as i have severe nerve pain down my left leg. This is only part of it as i get sciatica down both legs either at the same time or either leg. i can loose feeling in either 1 or both legs at a time. I'm going for another op and don't think i'll ever be able to go back to my work. I got my SSP for the first 28 weeks and now incapacity and DLA. sorry for being so long winded but my question is am i entitled to any redundancy from my employer and how do i go about getting it. As i stated i've been off now for about a yr and a half.

    In order to be made redundant, your job has to be made redundant, not you, if that makes sense. You could ask to be made redundant but if there is still work for you to do, they are likely to turn you down.

    I asked to be made redundant because there was not enough work for me to do and my job had changed significantly, removing a lot of my duties, which I felt could be done by someone else. Work accepted my request, possibly because I think they would have done it anyway at some point before the end of the year.

    As you have been off sick for so long and it is unlikely that you will be able to return to work then it may be better to ask for ill-health retirement.

    You cannot ask for redundancy if your job still exists because it is the job that is made redundant and not the person.
