Need some HSBC help

Hello everyone. I am here to get some advice. Here is the scenario:

- me and my father have a joint business partnership account registered at address X
- we sell the business and for some reason a direct debit goes out and the bank account is overdrawn 25 pounds or so in december 08. We have no idea becos all correspondence is to address X.
- Yesterday, I see 200 pounds missing from my personal HSBC account. I visit HSBC and turns out they had charged the orig business acount all the way up to - -£370 pounds and conveniently just took 200 from my personal account without giving me ANY PRIOR NOTICE. I did not receive anything from them Now the business account is still -£170 or so which they want me to pay up.

What can I do in this situation? Can they really just take my money from my personal account? If they had found my right residential address ( they had my residential add. on the business acoount file God knows why they never contacted me thru that) surely, they should have sent me some letters first b4 debiting my personal account?

How do i get my 200 back and at the same time not have to pay the stupid fees.

p.s Do i have to clear the negative balance on the business account before I can do a claim for bank charges? if not, will claiming just freeze everything until a decision is made or canthey just keep adding more and more money on top?

    Firstly they can take money from your account which is called the Right of Set Off. Secondly, have you spoken to your former partner on the account cos surely they would be liable for the other amount. And yes you can claim back charges but it won't freeze the account for getting charged.
