:mad:my daughter wrote to MBNA to as for copies of her statements and any paper work .I noticed that she had not requested PPI or even signed anything to say she wanted it so she wrote to them asking for a refund as she had not wanted PPi. Well she got a reply today saying " that the agreement was made verbally over the telephone. They also that they do not have a signiture to make it legal and binding. Can this be right does she still have a right to get it back. What should we do next:mad:

Hi there
You are still entitled to complain if your not happy.
Give them 8 weeks as these are the timescales they are given to resolve the complaint, and if your not satisfied with the outcome you can always try the financial ombudsman service (FOS).

She can try to reclaim but it may be more difficult if she agreed to it on the phone and the call was ok (as in the advisor didn't tell her the wrong info or tell her she HAD to have it)0

The thing is, there was no such call. and mbna also stated that they have no recording of the so called phone call so i think they expect us to just take there word for it. surely they cant do that. they can say that about anybody surley that is not legal0

If it was a credit card, then there would have had to have been an activation call before she could use the card and that is where it was sold.0
