Rent Depoist

Hi Guys first time poster here I am after some advise about by Depoist from renting a flat.

When I payed my depoist to the letting agents they told it would be secured in a depoist protection scheme and all the details of this are also in my contract but now my letting agency have gone bankrupt. I contacted the depoist protection scheme in the contract to confirm my depoist is still safe and they informed that no account had been set up with themselves for me. I am now wondering is there any way to get my money back from the letting agent. Thanks in advance for the advise

    Ask the agent to confirm which protection scheme they used to protect your deposit - maybe the wrong one was listed in the contract.

    This is assuming that you have allowed sufficient time as the LL has 14 days to register a deposit.

    Sorry to hear the agent has gone bust. However your CONTRACT is with the LANDLORD not the agent. So, write to him & ask for the certificate of where the deposit has been placed. If it isn't in a deposit scheme the LL can be fined 3x the deposit (which goes to you..)

    That the LL doesn't have the money is tough (on him) but his problem. The agent was LL's agent, not your agent. He will have to try & get deposit back from agent, but at the end of the tenancy he will, whatever else happens, still owe you the deposit less agreed deductions..

    Gareth - check for yourself with each of the 3 schemes - see here and get written confirmation (email will do) either way.

    Then ,as Artful suggests , get straight on to the LL. If you haven't got the LLs name and address you can check at the Land Registry for a few quid or you can make a formal written request to the LA for that information to be provided.

    Do you pay your rent direct to the LLs bank a/c or to the LA?
