Reclaiming CC Charges - debt passed to debt collectors

Hi folks,

I know that this information will be on this forum somewhere.....but I've searched and can't find it so I'll ask again:

I'm claiming back CC charges from a couple of credit cards that have been passed to debt collectors. So far I've had offers from them, which I have rejected and am hoping for better offers. Anyway, both have said that the amount they are offering will come off my balance. This is fine, however it doesn't allow for negotiation on settlement with debt collectors. E.g. My balance on one card is £1200, but they will settle for around £900. I am claiming £1100 (hoping to get about £900) and if I get it the credit card company will pay it straight to my account and I'll still owe £300. But if they pay it to me then I can negotiate the settlement and clear the debt.

Is there any way around this? (hope it makes sense)

    As soon as you put in letters to the credit card providers the debt is in dispute and you should make the Debt Collection Agencies aware that the debt is in dispute with the Original Creditor and you will only deal with them.
    Furthermore, if the offers are not 100% of the amount you are claiming then you either (a) sue them or (b) accept their offer or (c) negotiate but if they do give you a final response then I would sue them.

    If you do accept the claim, make sure you send a copy of the confirmation of how much you are getting back in your account to the debt collectors, then they can adjust accordingly x
