Seller Refunded, Then Open Unpaid Item Dispute!

Hi Everyone,

I wondered if anyone could enlighten me.

I won the bid on an item on the 27th April and paid for it straight away. A week and a half went by and no item, this wasn't a problem but I was moving on the 11th May and wanted to make sure it was on it's way.

It turns out the item was lost, the seller was unhelpful and did the absolute minimum to help. This went on until the 14th May, so I got !!!!!! off, left a neg and was prepared to forget about the whole thing (the item was v. cheap).

Without a word the seller refunded me, but then must of noticed the neg, got my number and called me in an attempt to get me to withdraw the neg (I refused). The following day, 15th May, she filed a unpaid item dispute.

What I wondered how can I get this situation resolved? I don't want a strike, but I'm not prepared to withdraw the negative when the seller was so awful.

    First off - is it definietly an unpaid item dispute, or a mutual cancellation? Both are processed from the same resolution screen and look similar. A mutual is a way for the seller to get their fees back in genuine cancellations, but it is up to the buyer to agree to cancel. If the buyer doesn't agree, then the seller doesn't get their fees.

    If it is an unpaid dispute, then that's an ill thought out plan by the seller.
    You MUST respond to it - if you don't, then the neg you left will be annulled.

    Respond to the dispute with the transaction ID and date from when you sent the paypal money across. If the seller does close the dispute against you and issues a strike, you can appeal through this link - http://pages.ebay.co.uk/help/buy/appeal-unpaid-item.html - again, provide the paypal information and they will reverse the strike quickly for you.

    Thank you, I responded straight away as knew it was coming (she told me that she would issue me with a strike when we spoke on the phone).

    But I just wondered what to do next. Do I just wait for the dispute to lapse, then try and get it overturned as you've suggested?

    If you have responded, the seller has the choice what to do next- either close and strike, or close and forget. If they do nothing for 30 days (i think) then it automatically closes in your favour.

    Get the details handy though just in case - if you still have the option to add comments to the dispute, then put the transaction details in, just so they are stored against the events.

    In my original response I put all of the transaction details and the facts of what happened, I just hope she doesn't close it and just let's it run...
