wrong item arrived from play.com

Hi, i recently ordered a game for my xbox 360 from play.com. The package arrived today with the wrong game inside it (ironically, one i was contemplating buying instead). the invoice was for the game i ordered, and i re-checked on the website that i had ordered the correct game. I have checked and both of the games are the same price.
I have looked through the play.com website and have found that i can return the order for a full refund if I wish (assuming they would be resposnible for re-postage costs).
what im wondering is, can i get them to send out the correct game without returning the other one they sent me? and if i can, how would i go about it? the only proper contact information i could find was a phone number. i couldnt find a direct e-mail address or anything. cheers, Ian.

Sorry Ian, I don't quite follow what you're asking.
You have a game by mistake in your hand, but still would like the intended game, and would like to keep the game they sent by mistake?
Then you need to buy the second game? Or I have completely misunderstood?0 -

well from reading that im not to sure what you want
do you want to buy the game you originally bought again and correct their mistake so you effectively buy both games?
do you want to get them to send the other game and then keep both? (illegally)
or do you want them to send you the other game and then send back their game instead of them waiting to receive the game back?
as for the delivery, yes they will have to refund you but its exactly that, you will need to pay and then claim a refund, if you dont like this idea tough, you could perhaps ask them to send you a prepaid postage sticker but i doubt they will.
sorry if the tough bit sound harsh! not meant to be rude or anything but its the truth.Back by no demand whatsoever.0 -
what i was looking to do was keep the game they sent me, and for them to sent me the game i origionally ordered too (without having to buy it again) - because they made the mistake. Sorry if i was rambling a little.
If thats not possible (legally - previous poster said it might be illegal?) then i will either re-order the origional or post back this game for a replacement. cheers, Ian0 -

yes this would be illegal as you are with-holding goods that you have no right too.
very similar to stealing (taking without the intent to later return) you are contemplating withholding without the intent to return
yes its their mistake but thats exactly it, its a mistake,
i am intrigued, there was an uncanny post a few weeks ago where the op was in the same position, mite be worth looking for that one but basically, if you want to keep the game sent to you out of error, you need to call up, explain the error and ask what needs to be done (how to pay) about the other game so that they may correct their stock etc
if you cannot afford this then you will need to send the first game back(recorded delivery to cover your back!) and wait for them to send your game. you will then have to write to them requesting them to repay delivery costs you incurred and possibly a reasonable amount for any petrol and parking costs if these apply (if you do go after these then be reasonable! claiming more than itr cost you will completly discredit you and make it hard to get anywhere). Do this all in writing with photocopys of reciepts provided to prove yours costs, perhaps as an email though as posting a letter would just incur you more costs.
hope that helpsBack by no demand whatsoever.0 -

you obviously didnt read the one where the poster wanted to keep the expensive box set because they couldnt be bothered to go to the post office, and didnt think they should pay the extra as it was a fair amount more expensiveBack by no demand whatsoever.0
