I had a CC with MBNA and got into trouble. At present I am paying a set figure every month and MBNA are not charging any interest. However, in getting to that situation I obviously received charges on the account which are now included within the debt I am paying off.

I have not tried to reclaim these charges (indeed, I haven't even asked them for the figure) as I am worried that, if I do, they would cancel the agreement and the whole sum becomes due.

Am I correct in assuming that they could cancel the agreement and suddenly start recharging interest and take me to court for the balance?

    MBNA wouldnt take you to court.

    It is possible that the refund you recieve would mean that your payments being made now would be in excess of the minimum and therefore interest MAY be applied to any remaining balance.

    HOWEVER, I have never seen an agreement being cancelled due to the charges being reclaimed - and I have seen several hundred similar situations ( I work there!!).

    I would reclaim the charges (dont accept the firsr offer, they always pay in full, with interest after the second letter) - but remember any offer they make will go towards your balance.
    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

    Ask them for copies of the statements so that at least you will know how much you are charged and how much it would reduce the overall amount you would be paying back. If they did cancel the agreement and you are paying on time with no arrears then it would retaliatory and I would expect you to complain to the FOS with regards to it.
