unbelievable!! well I thought so..

We are selling and having took the good advice offered here, decided not to view houses we were interested in until their was a sale agreed on ours...

Sure enough we sale agree the sale of our house. Our buyer is represented by our estate agent and tells us there is a complete chain ready to go. That night we view a house and sale agree next morning.

Estate agent encourages us to get everything moving, so I arrange a solicitor contact the bank. Within a week/week and a half my mortgagae is approved and the valuation of my planned new property is complete. A week later still no valuation of my house....

Soon after I get a phone call from estate agent...slight propblem we have received a solicitors letter your perspective buyer has a problem. Turns out his house was passed to him by a living relative who needs to give permission for the house to be sold, and you guessed it won't.

We immediately put the house on the market.....This was 3/4 weeks ago we have had one viewing since...Today I get a phone call the house we wanted has been agreed to someone who can move....

If Im honest Im not too gutted about the house I know there will always be another, Im gutted that I have wasted alot of money arranging a mortgage/valuation on a house when in reality there was no position to move on.....

Come on who trys to sell their house not getting permission from the person who in essence owns/has a say over it.....

I am so angry, the estae agent has made sympathetic noises but in reality has not been able to offer any explanation as to why they are still representing a guy who is so dishonest.... yes he is supposedly trying to sort it...the detail of what that involves is unknown to me..

    The person blocking the top end of our chain refuses to exchange until she has sorted out some legal stuff unrelated to the sale of her house. This has been going on since December, we get fed one story after another. Each story will apparently be sorted in the next 2 weeks and then out pops another story. Our buyer has exchanged on his sale and so is effectively a cash buyer of our house. He could easily look elsewhere if the problems don't get sorted.

    Every one in the chain has spent money on solicitors, mortgages and surveyors and this person is really not ready to sell yet. Makes you wonder why she put the house on the market in the first place. Grrrr!

    What a bummer dprovan. To have wasted your money because of someone else's studpidity.I can only imagine how you must feel.

    Fingers crossed everything goes smoothly for you when you find another suitable house.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    what about my colleague whose seller had just decided to take the house off the market while she has just completed on selling hers?

    Will your colleague get compensation from the seller on money spent on valuation/survery/solicitor etc?

    the sooner they bring in sellers pack the better and change it to the same way as scotland...... ie shake/agree on offer is binding........ these two things will iron out a fair few people from causing these type of problems

    my colleauge did not get jack !!!!!! and she had already paid 1,400 for the sollicitors and searches

    the lady she was supposed to by from wanted to be mortgage free for her next house because she was working part-time and was going through a divorce with a kid. She found on a 3yo newly built house, mad an offer but pulled out because the valuation (not bothered with a structural) pointed out there was a drop in the drive (she was afraid of possible subsidence)

    the second one she put an offer on, she pulled out because: "it did not feel right", one week before completion

    then the week after, she pulled her big house (the one my colleague was buying) out of the market!

    my colleague is now going ahead with selling her house because she does not want to risk losing her buyers nor inflict the same crp to them and also, their fixed rate mortgage was expiring in April. Her family is now packing to move in with her parents.

    At least they will be chain free!

    robnye, sellers pack will not stop this happening. Its one of the reasons why so many in the industry are against them. Buyers & sellers will still be able to withdraw without any recourse to either party. Scotland isn't the wonderful system that everybody thinks, before you put an offer in you have to have a survey done & (i believe) some legal work. You then put in your offer, if it gets rejected you've probably just lost £5 - 800. Put in a couple of offers that you loose out on & it can get real expensive.

    Agreed that this is the downside of the Scottish system, a few outbid offers and the costs start to rack up.

    To me, the upside is that, in normal circumstances, everything is tied up and signed within a couple of weeks and is then binding. Plus, each transaction stands on its own feet, there's none of this chain nonsense. Once a date is agreed, you're moving in or out and that's it. If your other transaction goes pear shaped, then it's your problem not that of an entire chain.

    There must be some sort of middle ground that could be achieved, taking the better parts of both systems.

    That's really bad!

    What do you think about this:

    When offer is accepted, buyer to deposit 1% of house price to solicitor and if buyer pulled out, this deposit will be given to vendor. If vendor pulled out, vendor needs to pay the same amount to buyer as compensation. (obviously there should be some exceptions clause such as survey results in subsidence etc.
