DLA Appeall

I am due to go to tribunal soon for my 15 year old sons renewal for care and moblity, if the appeal fails how long do i have to wait to put in a new claim
We are taking a CAB helper with us.

    You can put in a new claim if his condition has changed but not on the same information in the "lost" claim.

    If there are problems with the appeal, on a point of law there is further action you can take but lets cross that bridge when you need to.

    well over 1/2 child DLA claimants lose there awards at 16-18 because they are assessed under diffrent criteria, may I ask what your son is claiming for, I am looking at this point. Its stupid to think that well over 1/2 (2/3 some disabled organisations say) of disabled kids wake up one day and are ok. I read on a web site a couple of weeks ago the stats and I am looking for any info I can to see why these figures dont add up.

    Good luck with the tribunal,what I did(my child had their tribunal only a few days ago,and got hers.)I got information from her C/A,Teacher,went to the GP to update her(she hardly ever see's the gp about her disability) if your child goes to a club etc ask them for a report,while you also write a letter for the panel(post a few days before tribunal is held,so they have the updated and extra information from other people who know your child,and explain on your letter about why you are appealing,and tell them everything!!!,and also enclose the extra information from the other people. I did this,it helped me to,and the panel was pleased with what I wrote,and the extra information helped,my child had to go in to see the panel,they where great with her,sorry for going on,good luck,hope you will win,but really try not to worry too much,sorry I cant help with your actual question,but I know how you feel........let usknow how you got on......

    hi, He has very hard to control colitus and is in and out of hosptial all the time to try and control it, he spends most of the time on the toilet and we filled the renawl form in with the same information he had won on appeal the first time around.

    colitis is quite rare in children his age, maybe the DM didnt look it up when refusing your sons DLA maybe if you could get some checkable reliable information about his condition it could help the tribunal to understand this terrible condition.

    As I said in my first post evidence and more evidence is the way to win at appeal, good luck and if you need any specific information please post here.

    50% of appeals are won so there is always a good chance that the tribunal can overturn the DMs.
