Everybody who makes a claim to jobseekers allowance will be asked why they are no longer working, if they state laid off unless we know a particular company are having redundancies a form is always sent to the previous employer, obviously if they don't reply there isn't a lot that can be done but if they write back and state you left or were sacked then no benfit, and serves you right for lying. :rolleyes:0 -
Well ive always said its been temp jobs or contract jobs and no questions have ever been asked. Never seen one of these fancy forms you supposedly send to the 'employers'. Must be a thing thats done 'down south' cause it sure as hell doesnt happen up here.0

Hi, I am just about to leave my job as I have been bullied at work, it has not been possible to sort the problem and now I just want to go. If I leave voluntarily does that stop me claiming jobseekers allowance? thanks for any help
So far as a claim for Jobseekers Allowance is concerned there are three main issues that would need to be investigated. The first is whether you did all that you reasonably could to try and resolve your grievances (about the bullying) through your employer and/or trade union before you left. The second is whether there is any medical evidence to suggest that staying in the job would have adversely affected your health. The third is what efforts you made to find another job (to avoid becoming unemployed) before you left. The more evidence that there is to support each of those issues, the less likelihood there is of a sanction being imposed. If a sanction is imposed and you think it is wrong you will still have the right to appeal to an independent tribunal.0 -

All resons as to why a job has been teminated should be investigated and the form doesn't go via you to the employer. if you have only signed for a short term by the time the form has been returned, if at all by the employer, it would then go to a decision maker or be investigated further and you probably wouldn't even be aware of it.0

Thanks to all of you who were good enough to reply. I have been going through the complaints proceedure at work, still don't know how it will go! Wish me luck!

No that is not 100% true. It is up to the EO as to whether the form is sent off to the company. Not all reasons are questioned either, especially if it is for an Agency;) for instance up to a couple of years ago ANY job you had in the last 6 months prior to claiming benefit could be investigated for LV.
That has changed now and it is only your LAST job which can be investigated, so you could have been in a job for 12 years. Leave on the Friday and you can't claim benefit for 6 months. BUT if you leave on the Friday and start work at a Agency on the Monday then that is a totally different job and there is no way they cant contact the previous employer. As it is an Agency they will not send the LV forms to them as it would be "short term contract".
Nothing the department can do in that instance.:beer:We took on Mr T and we won:D

You should persevere with the complaints procedure (who exactly is bullying you and what form does it take)
Then apply for constructive dismissal if nothing is done about it.Learn from yesterday, live for today, hope for tomorrow. :cheesy:0 -
EXACTLY the same position here, they persist on getting more detail.. problem is i gave them a different story as to why i left (didn't want to admit bullying)... i don't think they're buying it and im going to lose my JSA i think....
if i was a minority group im sure it wouldn't be a problem though
