Making Claim on Old "Joint" account

Hi,

Looking to start my claim on hardship grounds - now in a position where my salary doesnt even cover my charges on CC's and bank yet alone actual repayments, my main joint account was held for number of years with previous OH - have since split and she "kept" the overdraft (£4k) and the account even tho she only works part-time!!

I had to set up a new account and am getting hammered for charges as overdraft was only £300 and normal divorce fees have set me back a large wedge - hence my escalating position.

I know my own account will not be an issue to start a claim, but can I make a claim on an account I was previously named on even tho she has retained the account as a sole account holder(I was just removed)?

Do I need her permission to get this info?

    You can't if you were removed from the account since you have renounced it. It will be hers to claim.

    Sorry - when I said "Removed" it was a joint decision between her,myself and bank - it was not enforced, does this make any difference? (sorry not legal eagle on this) :o

    Makes no difference, the account is in her name. I am going to double check myself on this one. It was a joint account and is now in the name of your ex. Is that right?

    Yes, it was held for about 15 years as my main account, got married - she got named on it, then got divorced and she kept it on due to the overdraft amount and to give her some leeway whilst she was looking for work. I since changed to my other account I have had for about 8 years and because of the o/d limit am now getting charges all over the place.

    Things are ammicable so wont be an issue if I need ex'es authorisation.

    Is the account a joint account still or is it just in her name. If it is just in her name, I am afraid you can't claim on that account.

    Just in hers....will he to tell her to apply and we can split anything that comes back I guess!
