Reclaiming Nat West Bank Charges

I have received a letter back from Nat West after submitting my income/Expenditure to show that I'm in financial hardship. They sent me a letter yesterday requesting that i send them proof of loan payments, rent and arrears that i have, HP agreements etc. Surely they can see from my accounts these payments leaving my account each month and that I have been charged more than 6 times in the last 12 months as this being hardship.

Why are they being so awkward ? Has anyone else had this problem or any suggestions would be grateful

    I've been trying to reclaim from Natwest for 3 months now. Yes, they have been difficult. They have refused to give information to me, ignored letters and repeated requests for information that has already been sent. Just this morning I have recieved a letter from them asking for documented proof of my rent and council tax payments. I have already toold them that I pay my friend, I am a lodger in his house, cash every four weeks for the rent and bills and they have agreed that they can see on my my account that I withdraw £250 every pay day for this. Yet they still ask for this 'documented proof'.
    In short my case has now been passed to the FOS.

    Part 6 of annex 2 in the FSA Waiver on Bank charges states this:

    "6.
    Where the firm does not have sufficient evidence to assess whether or not the complainant is in fact in financial difficulty, the firm will seek such further relevant information as is reasonably required to make that assessment. In the event that the firm reasonably requires relevant information to be provided by the complainant and the complainant does not provide the requested information within a reasonable period of time, the firm shall not be obliged to treat such a complainant as being in financial difficulty."

    I would photocopy the relevant paperwork and send it back into them. They have every right to ask the questions and the right to ask for further information. Without it you can see above from the waiver, "the firm are not obliged to treat such a complaint as being in financial hardship".

    Many thanks for your response. I do not have all of the information they have requested but do have most of it. Will this affect the claim ? The info i do not have is for costs to upkeep/repair my home.

    Send as much info as possible and hopefully you will get a positive response.

    I have gathered as much as i can find for the time being. Which is surprisingly alot but not quite enough I fear. They have asked me to supply a breakdown of £150 repairs and upkeep. Any ideas ? If I do not supply evidence for each of their points will they state that i am not in hardship ?

    Just to add to this question, if a bank I am claiming from asks me for proof of rent arrears, would I ask for a letter from my mother ( I live with her and pay rent to her as part of the whole rent) or her rent statement which shows the arrears? x

    The repairs bit I would look for receipts and as for upkeep, not sure I would be inclined to supply anything. Upkeep is upkeep.
