    tjdjer, my personal view is that you aren't in financial hardship as defined in the way the banks' are looking at the FSA Waiver on Hardship, ie priority debt arrears. With regards to what MSE has said in regards to reclaiming charges, I would agree with them but in respect of claiming hardship however HSBC are absolute hard nuts.

    As a further point with regards to the OFT test case, we are at the stage in which the preliminary issues should be resolved by the House of Lords decision albeit, I would agree it won't be June.I doubt a further appeal will be necessary. Whether the waiver will be lifted and stays as well is debatable. I don't think they will be but others take an alternative view.
    However, I suspect that the Substantive Issues will be a lot quicker since they have been streamlined to three main banks terms and conditions.

    Well the OFT so far have not argued in court over the charges so if they don't then we are back to square one and consumers taking cases to court. The credit card report from April 2006 was a provisional measure, if you read OFT842 it is clear that the £12 was not meant to be a threshold and that credit card providers went down to that amount.

    Will post further with regards to the other post. And I think consumers aka the OFT will win unless the House Of Lords overturns its own decision in the First National case from 2001 and quoted vastly in the first two cases, ie hearing and appeal.

    You have mentioned homelessness, can you live at your mums address? Would you have been able to stay at student accommodation regardless of whether you are working or not?

    As I said have a look at the direct gov link and it explains priority and non priority debts. If you feel that your circumstances are priority debt arrears then fight like a dog on hardship, if not then, you are fighting a losing battle that will take your energies away from bigger battles that you may want to tackle.

    BTW, any charges on those catalogues we can look at(and therefore put the accounts in dispute meaning those bailiffs can be kept away).

    Tjdjer, as a complete aside, I have a failed interview at McDonald's as well and I can raise you a failed ASDA interview(now they are an experience so if you got one near to you, definitely apply).

    I refuse to give up I am just going to keep on applying... I really want work for the summer.... Just can't find any. If I don't get a paying job by end of june I am going to do voluntary work again!

    Finding a job does seem to be a nightmare. Glad to see its not just me that fails McDonalds lol!! x

    For me, yesterday was exactly 100 days out of work. You gotta keep applying and remember to sign up for recruitment agencies as well. If your CV is up to date then get it on sites such as reed and totaljobs. Keep an eye on the Jobcentre website and check your local press which will normally have a jobs section. That is the kinds of stuff that I have done. And the most important is to stay positive about it.
