I submitted a mcol against capital one on saturday, I checked the form several times and saw no mistakes.
Today I've opened my post to find that cap1 are listed as the claimant and I am the defendant!
I suppose I will be laughing at this in a few hours when the shock wears off so don't feel bad if you have a chuckle yourself;)
Does anyone know how I can change this, and more importantly will it cost anymore?
I have just sent an email to mcol but I am looking for advice as I know I will probably be phoning tomorrow to try and sort this out.
Cheers Carlos.

If you pressed submit in error and your claim has gone through, you can stop it by contacting MCOL by fax or email before 10am the next working day.
You must quote your claim number, name and address, who your refund should be made payable to, and the reason why. Your claim will be withdrawn and a refund sent out by payable order.
Where MCOL receive notification too late, the claim will be issued and the fee cannot be refunded0 -
Thanks Natwest I know I said have a chuckle but to suggest that I work for a bank is a low blow:rotfl:
Thanks Orford, the claim is dated the 18th. I checked online yesterday afternoon and nothing had changed from when I submitted. I recieved the claim today and have emailed them tonight. I will phone them tomorrow morning, 20th, but will this be too late?0 -

Q. I have made an 'obvious' mistake on my claim, I entered myself as the defendant and the claimant, what should I do?
A. In this situation the mistake made is obvious. You can withdraw that claim and issue a new correct claim rather than applying to amended it. You should e-mail or fax the court requesting to withdraw the original case with your reasons and request a refund. You must quote the new claim number and your name and address so a payable order can be sent out. This applies to situations where the claim is a defendant vs a defendant, a claimant vs a claimant, or the defendant and claimant details have been entered the wrong way round.
I found this on the HM Courts site. It looks like it's a pretty common thing, so don't feel bad. You won't be the first, and certainly not the last. Hope you get it sorted. (apologies but I did laugh when I read your post too
) We could all learn a little something from the weather. It pays no attention to criticism.0 -
Thanks for the help, I've just completed a new claim, incorrect claim is barred and I've emailed the 2 claim numbers and my address to get a refund.
I'm able to have a good laugh now and I'm glad I've bought a bit light relief to everyones reclaiming experiences:rotfl:
Just remember there may be a few bumps along the way but we'll all get there in the end;)0
