DSA keeping my fee

Hi all,
I'm not sure if i'm in the right place here, anyway i'll ask any how.
Today was suppose to be my driving test, and i arrived late, by time the examiner came into the waiting room he told me that he wasn't going to do the test as i was 6 mins late, by all the ADI's watches in the waiting room they said i was 5 mins late, apparently they allow 5 mins.
Have the DSA got rights to keep my fee and not offer me a refund or another appiontment (this doesn't really matter as i have re-booked), cause to me this seems unfair and just a way to scam people out of money.

It may seem unfair but you should have been on time. If everyone was late by just 5 minutes, the poor person on the last test of the day would probably have their test cancelled due to running out of time and that really wouldn't be fair!0
