I have posted this on the credit card section earlier today because i didnt know where else to post it. Ive now just found this board and i think its probably a better place for my post.
On friday i bought two tickets to see Ricky Gervais in Nov via the ticket factory.
When i got the confirmation email the seats showing were different (and much worse) to the ones i agreed to buy. I phoned customer service and they said they cant do anything about it.
I paid using my debit card as its a Visa and is covered by the same rules as credit cards. I phoned my bank and the first person i spoke to said it wont be a problem doing a charge back but i have to wait for the money to go out. So i phoned today and was told that i cant do a chargeback because they are still offering me seats.
So im confused as to whether im entitled to a charge back. On the one hand they are offering me seats, but on the other hand its not what i agreed to pay for. Its like ordering a new car and they send you a second hand one. Ive got the car but its not what i asked for.
I guess the other thing worth mentioning is that i have no proof they have given me different tickets so i guess its my word agaisnt theres.
Is there anything i can do in this situation? Someone on the credit card board mentioned i should contact trading standards but i dont actually have any proof so i dont know whether anything will come of it.
Thanks
edit: i phoned my bank this morn again and the guy i spoke to said theres nothing that can be done because i have no proof that they have sent me the wrong tickets as all they have to go by is whats on my ticket confirmation. Thats pretty much what i thought, although i thought it was worth a try. Guess i will have to try and sell the tickets. Not a happy bunny. But i apprecitate that theres nothing the bank can do.

Bad news im afraid.
It is likely there is a sentence somewhere in the t&c's that says something along the lines of "where there is no availability a similar standard will be offered"
Might be worth calling consumer direct.
But i really wouldn't hold your breath.0 -
I had a similar problem with another ticket company so i sent a strongly worded complaint via email, a few minutes later their customer service manager called me and sorted it all out!!
Might be worth a try - i think the people that read the emails are different to the "customer service" people.0
